'Those who want to feed street dogs take them home' says Supreme Court

The Supreme Court on Tuesday indicated it may impose heavy compensation on state governments for every dog bite and dog-related death, while also fixing liability on dog feeders in cases where attacks leave victims with lifelong consequences.

Hearing the matter on stray dogs, the court questioned why street dogs should be allowed to roam freely and chase or bite people. The bench observed that states have failed to make adequate arrangements to address the growing menace and warned that financial liability could follow in cases of injury or death.

The court also raised concerns over accountability of dog feeders and organisations that feed community dogs. It asked whether such organisations should be held liable when children or citizens are attacked by dogs that are regularly fed and supported in specific localities.

During the proceedings, the bench noted that it is impossible to predict a dog’s behaviour at any given time, rejecting arguments that empathy alone can prevent attacks. The judges stressed that the issue was not limited to bites but also included the constant threat and fear posed to the public.

The court is hearing a batch of petitions on stray dogs and cattle, and has earlier ordered the removal of stray dogs from institutional premises such as schools, hospitals and transport hubs, directing their relocation to shelters after sterilisation and vaccination.
